The group were enjoying dinner in Duroseau’s yard in Queens when a neighbor, Marcus Rosebrock, allegedly hosed down the group with water
Rosebrock attacked them after a female accomplice also threatened them with her German Shepherd during a complaint about the noise, the lawsuit claims
A leading doctor who threw a backyard party for his sister’s birthday in Queens claims their group was ‘hosed’ with water by a ‘racist’ white neighbor during a noise dispute, according to a lawsuit which likened the incident to 1960s Alabama.
Dr Yves Duroseau, who was the first US physician to receive the covid vaccine, and more than a dozen of his guests allege that neighbor Marcus Rosebrock, a 48-year-old married father-of-two, violated their civil rights by attacking the group.
A lawsuit brought by Duroseau and his guests – who include a music executive and several prominent lawyers – also alleges an unnamed woman, named as Jane Doe in the suit, threatened them with a German Shepherd dog during the incident.
Rosebrock, a German national, denies the allegations and ‘rejects any characterization that he is racist’, according to a statement from his lawyer.
The suit states that Duroseau – chair of the emergency department at Lenox Hill hospital in New York City – threw a party on Saturday, September 17, 2022 for his sister Rosevony Duroseau’s 47th birthday.

The gathering was held in the yard of his Forest Hill home and included around 15 guests, most of whom were black or Latino, according to the suit.
Guests included Rigo Morales, a record executive who has worked with Eminem and 50 Cent, along with lawyers and banking bosses. The suit said many of those present were friends Rosevony met at Fordham Law School.
They enjoyed a nine-course al fresco dinner cooked by TV chef Vanessa Cantave, who won the Bravo reality cooking competition Rocco’s Dinner Party in 2011.
At 9.50pm when the party was ‘winding down’, the female defendant known as Jane Doe ‘entered the Duroseau home uninvited with a large German Shepherd and demanded that the music playing in the backyard be turned down’, according to the lawsuit.
Cantave and her business partner, Shani Porter, feared the dog ‘would attack and seriously injure them as it appeared menacing and aggressive’. They went into the yard to inform Duroseau and his sister, who is a US Citizenship and Immigration Services asylum officer, about the complaint.
Dr Duroseau told the woman the party would be ending soon and requested that she leave his property, before he returned to his yard to continue socializing.
But soon after, Rosebrock, whose yard neighbors Duroseau’s, ‘took his water hose and began water hosing [the guests] in the Duroseau’s backyard to get them to disperse’, according to the suit.
The suit said the incident created ‘a scene reminiscent of 1960s Birmingham, Alabama, when white law enforcement officers used fire hoses to douse, assault and batter African Americans participating in civil rights demonstrations’.
The suit alleges Rosebrock increased the pressure of the hose during the alleged attack so that it was ‘extremely powerful and stinging in nature’.
Rosebrock allegedly subjected the group to a prolonged attack until they were ‘completely drenched.
Police were called and two NYPD officers responded to take a report, but there has been ‘no follow-up since then, even though this incident should be investigated as a hate crime’, according to Derek Sells, a lawyer representing the group.
The suit accuses both Rosebrock and the woman of being ‘racist’.
The suit adds: ‘Each of the plaintiffs suffered economic losses as a result of [the defendants’] conduct.
‘Unable to use their property for a peaceful gathering, and humiliated, put into fear, embarrassed and degraded, plaintiffs seek justice for the assaultive conduct, battery and civil rights violations’.
Duroseau and his sister are Haitian-Americans. The suit said they were ‘celebrating with family and friends, all of whom were black or Latino, except one’.
Lawyers for Duroseau and the 18 others named in the lawsuit told The Daily Beast, which first reported the case: ‘I was appalled and disgusted that water hosing and German Shepherds were being used against people of color in New York City in 2022. I was in utter disbelief.’
Malik said the guests remain ‘deeply scarred’ by the alleged ordeal and were ‘made to feel less than human’.
The civil rights claim in the suit said the incident violated Title 7 of the New York City Administrate Code.
